Berger & Webb has one of the most active and well-respected condemnation practice groups in New York. Our condemnation attorneys counsel government agencies on development projects and eminent domain proceedings of all magnitudes and complexities, and we also represent condemnees. We advise on every aspect of the eminent domain process, beginning at the time that condemnation is first considered and continuing through the public hearing process, acquisition, relocation, valuation, litigation, trials and appeals. We serve as counsel to various developers and other entities, providing them with legal counsel relating to major projects in which condemnation is likely.
By way of example, the firm serves as condemnation counsel for the Dormitory Authority of the State of New York in connection with two multi-million dollar development projects for the expansion of two colleges of the City University of New York – John Jay College in Manhattan and Medgar Evers College in Brooklyn. In addition, we represent the Metropolitan Transportation Authority with respect to its large-scale creation of the Fulton Street Transit Center in Lower Manhattan, the expansion of the Second Avenue subway line on Manhattan’s Upper East Side, and on the East Side Access Project, which will connect the Long Island Rail Road to Grand Central Terminal. We also represent the Empire State Development Corporation in connection with the Atlantic Yards Project, a major mixed-use development in Brooklyn featuring the Barclays Center, future home of the Brooklyn Nets.
